WagNote — Terms of Service

These terms are an agreement between you and the owner of WagNote ("we", "us"). They cover the WagNote mobile app and the WagNote website. By creating an account or using WagNote, you agree to them. If you do not agree, please do not use WagNote.

WagNote is operated by Eadrom Labs LLC, a Tennessee limited liability company, PO Box 1051, White House, TN 37188, United States.

1. WagNote is not veterinary care

This is the most important term in this agreement.

WagNote is a record-keeping and educational tool built by a veterinarian. It does not diagnose conditions, does not recommend or calculate medication doses, and is not a substitute for veterinary care. Always consult your veterinarian about your pet's health and treatment.

Our Medical Disclaimer sets out these limits in full, including the limits of the in-app assistant, what happens in an emergency, and the fact that reminders are a convenience and not a guarantee. It forms part of these terms, and you should read it.

You remain responsible for your pet's care, for the accuracy of what you enter, and for the decisions you make. Never delay contacting a veterinarian because of anything in WagNote.

2. Who can use WagNote

You must be at least 18 years old and able to enter into a contract. WagNote is offered in the United States, in English, and is intended for owners of dogs and cats.

WagNote is not directed at children, and we do not knowingly collect information from anyone under 13.

3. Your account

You are responsible for your account and for keeping your sign-in details secure. Tell us promptly if you believe someone else has access to it.

Everything you enter — your pet's records, logs, uploads and schedules — is treated as your information. See our Privacy Policy for how it is handled.

Sharing with your family. A Family plan lets you invite other people onto your plan so they can see and add to your pets' records. Anyone you invite can view and change the information on that plan. Invite only people you trust with it, and remove access when it is no longer needed. You are responsible for who you let in.

Sharing outside the app. WagNote can produce a shareable summary or care sheet for a sitter, a boarding facility or a clinic. What you share, and with whom, is your decision and your responsibility. Anything you share may be seen, saved or passed on by the person who receives it.

4. Subscriptions and billing

WagNote offers a free tier and paid plans (currently Solo and Family). What each plan includes, and any usage limits on the free tier, are shown in the app and may change over time.

• Free trial. Paid plans may be offered with a free trial. If you do not cancel before the trial ends, the subscription begins and you are charged.
• Price. The price is the one shown to you at the time of purchase. Prices may change; a change will not affect a subscription period you have already paid for.
• Billing. Subscriptions are sold and billed through Apple's App Store or Google Play, not by us. We do not receive or store your card details.
• Automatic renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends.
• Cancelling. You cancel through your Apple or Google account settings — not through us. Cancelling stops future renewals; it does not shorten a period you have already paid for.
• Refunds. Refunds are handled by Apple or Google under their own policies. We cannot issue or force a refund on their behalf, though you are welcome to contact us and we will help where we can.

If a paid plan ends, your pets' information is not deleted. Features that belong to a paid plan simply stop being available until you subscribe again.

5. What you may not do

Please do not:

• Use WagNote for anything unlawful, or to store anything you do not have the right to store
• Attempt to access another family's information
• Try to break, overload, probe, reverse-engineer or work around any part of the service, including its usage limits
• Use WagNote to provide veterinary advice to other people, or hold anything it produces out as a veterinary opinion
• Resell, rent or redistribute access to WagNote

We may suspend or close an account that does these things.

6. Your information, and our software

Yours stays yours. You keep ownership of everything you put into WagNote. You give us permission to store, process and display it for the purpose of operating the service for you — including sending it to the service providers described in our Privacy Policy, such as the provider of the in-app assistant. We do not sell it, and we do not use it to advertise to you. WagNote carries no advertising.

Ours stays ours. The WagNote app, website, name, logo, article library and design belong to us. Using WagNote does not transfer any of that to you. You get a personal, non-transferable right to use the app for its intended purpose while your account is in good standing.

Automated content. Some content in WagNote — summaries, explanations and assistant answers — is generated automatically. It is general information, it can be wrong or incomplete, and it is not a veterinary opinion about your pet. Check anything you intend to rely on.

7. Affiliate links

WagNote may occasionally link to pet-supply retailers and may earn a small commission on non-prescription purchases made through those links. This never applies to prescription products, and it never affects what the app tells you. A link is not a recommendation of a product for your pet — ask your veterinarian.

8. Availability

We do our best to keep WagNote working, but we do not promise it will be available without interruption or free of errors. Features may change, and parts of the service may be added, altered or withdrawn.

You are responsible for keeping your own copies of anything you cannot afford to lose. WagNote should not be your only record of your pet's health.

9. Ending your use

You can stop using WagNote at any time, and can delete your account from within the app. Deleting your account removes your information as described in the Privacy Policy. Deletion is permanent, so export anything you want to keep first. Deleting your account does not by itself cancel a subscription billed by Apple or Google — cancel that through your Apple or Google account.

We may suspend or end your access if you break these terms, or if we stop offering the service. If we discontinue WagNote, we will give reasonable notice and a way to export your information.

10. Disclaimers and limits on liability

This section limits what we are responsible for. Please read it.

WagNote is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, timely, secure or error-free, that reminders will be delivered, or that any information it contains or generates is accurate, complete or current.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, loss of profits, or veterinary or other costs arising from your use of — or inability to use — WagNote. This includes anything arising from a reminder that did not arrive or arrived late, from information you entered incorrectly, from automatically generated content, or from a decision made in reliance on the app.

Our total liability to you for any claim relating to WagNote is limited to the greater of the amount you paid us for the service in the twelve months before the claim, or twenty-five US dollars.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

You agree to indemnify us against claims, losses and reasonable costs arising from your misuse of WagNote, from information you shared with others through it, or from your breach of these terms.

11. Apple and Google

These terms are between you and us, not with Apple or Google.

Apple and Google are not responsible for WagNote, for its content, or for any support, maintenance, warranty or claim relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; Apple has no other warranty obligation. You must also comply with the App Store or Google Play terms that apply to you.

12. Changes to these terms

We may update these terms. If a change is significant, we will let you know in the app or by email before it takes effect. Continuing to use WagNote after that means you accept the updated terms. The date at the top shows when they were last changed.

13. Governing law

These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Tennessee, and you and we each consent to those courts.

If any part of these terms is found unenforceable, the rest remains in effect.
